Terms of Service

The terms governing your use of shelter.ie. Engaging Shelter for a productised pack is governed by a separate Engagement Letter.

1. About these Terms

These Terms of Service ("Terms") govern your use of the shelter.ie website. By accessing or using shelter.ie, you agree to these Terms. If you do not agree, please do not use the site.

If you engage Shelter for one of our productised packs (Cash-for-Keys Negotiation, RTB Acceleration Pack, or Documentation & Evidence Service), the terms of that engagement are governed by a separate Engagement Letter — these Terms continue to apply to your general use of the site.

2. Who we are

Shelter.ie is an advisory and project-management service for Irish landlords. We are not a solicitor's firm. We do not provide legal advice. References to "we", "us", "our", and "Shelter" mean Shelter.ie.

3. Nature of the service

Shelter.ie provides an advisory and project-management service in the field of Irish landlord-tenant disputes, including overholding, rent arrears, anti-social tenancies, and breach of tenant obligations. Our scope of work includes:

• Drafting documents (Notices of Termination, deeds of surrender, evidence bundles), reviewed by our partner solicitor before formal use
• Project-managing tenancy disputes through the Residential Tenancies Board adjudication and tribunal stages
• Co-ordinating partner professionals (solicitor, PSA-licensed Private Investigator, debt collector) where appropriate
• Acting as advocates at RTB adjudications and tribunals (which is not reserved legal practice in Ireland)

Our scope of work does not include:

• Provision of legal advice
• Representation in the Circuit Court, High Court, Court of Appeal, or Supreme Court (these require a solicitor on the record; we refer such matters to our partner solicitor)
• Surveillance work conducted directly by Shelter.ie (this is conducted by our PSA-licensed Private Investigator partner under their licence)
• Any conduct that would breach the Residential Tenancies Act 2004, the Non-Fatal Offences Against the Person Act 1997, the Criminal Damage Act 1991, or any other applicable Irish law

4. Not legal advice

Nothing on the shelter.ie website, including but not limited to the case studies, FAQ, blog content, services pages, and About page, constitutes legal advice. The information is general in nature and does not take account of your specific circumstances. For legal advice on your specific case, retain a solicitor of your own choice.

5. Use of the site

You may use shelter.ie for lawful, personal, and non-commercial purposes. You agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorised access to any part of the site or its underlying infrastructure
• Reproduce or republish substantial portions of the site's content without our written permission (factual case-study reporting that cites our analysis is permitted with attribution)
• Submit false or misleading information through the contact form
• Use the site to harass, intimidate, or attempt to identify any individual

6. Intellectual property

All content on shelter.ie — including text, layout, design, and the structure of the case studies — is the intellectual property of Shelter.ie unless otherwise indicated. Quotations from public sources (the Irish Times, RTB determinations, etc.) are reproduced under fair use principles for purposes of accurate reporting and commentary.

7. Disclaimer of warranties

Shelter.ie is provided "as is" without warranty of any kind, express or implied. We do not warrant that:

• The site will be available at all times or be free from errors
• The information on the site is exhaustive or applicable to every case
• Outcomes for clients will match outcomes referenced in case studies (every case is different and depends on its specific facts)

Our productised packs do not guarantee specific outcomes. The Residential Tenancies Board is a statutory body whose decisions we do not control.

8. Limitation of liability

To the extent permitted by law, Shelter.ie's liability for any direct or indirect loss arising from use of the site (excluding active client engagements, which are governed by the separate Engagement Letter) is limited to the amount you have paid Shelter.ie in the 12 months preceding the claim, or €100, whichever is greater. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited under Irish law.

9. Third-party links and content

Shelter.ie contains links to external resources (the Irish Times, the RTB, Citizens Information, Tailte Éireann, Threshold, etc.). We do not control these resources and are not responsible for their content. Linking does not imply endorsement of the linked site or affiliation with its publisher.

10. Brand distinction (important)

Shelter.ie is not affiliated with Shelter (UK), the housing charity, or with Threshold, the Irish housing charity for tenants, or with any housing-rights organisation. Shelter.ie operates on the landlord side of tenancy disputes. If you are a tenant, please contact Threshold on 1800 454 454.

11. Privacy and cookies

Our handling of personal data is described in the Privacy Notice. Our use of cookies is described in the Cookie Notice.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be highlighted in the cookie banner or via an in-site notice for at least 14 days.

13. Governing law

These Terms are governed by Irish law. Any dispute arising from your use of shelter.ie is subject to the exclusive jurisdiction of the Irish courts.
